Todd Tucker Seeks Primary Custody and Addresses Prenup Amid Divorce from Kandi Burruss

Todd Tucker has officially filed for primary custody of the two children he shares with his wife of eleven years, Grammy award-winning artist and Real Housewives of Atlanta star Kandi Burruss, as the pair moves forward with their divorce. According to new legal documents, Tucker is requesting primary physical custody along with a structured, long-term parenting plan.

Tucker stated that Burruss’ demanding work commitments “will continue to require her to be away from the children for the next several months,” which he cites as a core reason for requesting primary custody.

His filing also emphasized that “both parties have been working cooperatively to resolve all issues,” adding that he remains committed to continuing discussions “in good faith.”

Kandi and Todd share two children together: Ace, born in 2016, and Blaze, born in 2019. Tucker noted that “in the hopefully unlikely event” they cannot reach an agreement, he intends to seek primary physical custody, joint legal custody, and final decision-making authority.

Even with the legal requests, Tucker’s filing remains clear about Burruss’ role as a mother. He proposed that Burruss have “substantial time and meaningful access to the children,” acknowledging her as “a loving and capable parent,” and expressing optimism that continued conversations will lead to a full resolution.

The filing also addresses the couple’s prenuptial agreement, which Tucker acknowledged signing before their April 4, 2014 wedding. He suggested, however, that he signed the agreement without his own legal counsel present at the time. His lawyers added that the prenup “was presented to him without representation,” despite prior communication between Burruss’ team and Tucker’s regarding a potential agreement.
